Parenting Time

Parenting time is a facet of child custody. Parenting time refers to the schedule that controls where the child stays during specific time frames. Courts prioritize the child being able to have meaningful time with both of their parents, unless extraordinary circumstances exist. ​

What schedule will the court use?
Ideally, the parents would be able to negotiate a fair and workable custody and visitation arrangement. This reduces costs and minimizes stress. However, this is not always possible, and having a court order the schedule may be the best solution for some cases.
 
Depending on your jurisdiction, there may be a standard parenting time schedule that the court will default to. It is important to note that you are free to agree to a schedule with the child’s other parent, should such an agreement be reached. These standard parenting time schedules take into account the age of the child, and your county’s local rule should be reviewed to determine what the court will consider.

What can I do if my child’s other parent isn’t following the parenting time schedule?
If the child’s other parent refuses to follow the court’s order, they can be found  in contempt of court. It is important to note that the parent asserting that the order is being violated must prove that the order has been violated, so documenting the violations is very important.
